Terms & Conditions
This is a working version of DialTone's terms while we finalize the service for launch. A lawyer-reviewed version will replace this page before the first paying customer goes live. If you have questions about any term here, email hello@dialtone.menu.
These terms govern your use of DialTone, an AI-powered phone ordering and reservation service for restaurants. By using DialTone — whether as a restaurant operator who subscribes to the service, or as a customer who calls a restaurant that uses it — you agree to these terms.
01 The Service
DialTone answers phone calls on behalf of participating restaurants and helps callers place food orders or book table reservations. The service relies on third-party providers for voice (Vapi, ElevenLabs, OpenAI), telephony (Twilio), payments (Stripe), and hosting (Supabase, Cloudflare). DialTone does not guarantee uninterrupted availability of any of these providers.
02 Who these terms apply to
- Restaurants (operators who sign up for the service) — agree to accurately represent their menu, pricing, hours, and fulfillment capabilities, and to honor orders and reservations taken by the DialTone agent on their behalf.
- Customers (people who call a DialTone-equipped restaurant or reply to a DialTone SMS) — agree to provide accurate information during the call and to pay for any orders they place and confirm.
03 Orders and reservations
An order is considered placed only after the caller confirms the full readback from the voice agent. Payment is collected by the restaurant via a secure Stripe Checkout link sent by SMS; DialTone does not accept card information over the phone. Reservations are confirmed when the agent speaks the confirmation message and an SMS confirmation is sent. The restaurant has the right to refuse or cancel any order or reservation at its discretion, including for reasons of capacity, payment failure, or clearly erroneous input.
04 SMS messaging
By placing an order or booking a reservation through DialTone, you consent to receive transactional SMS messages at the phone number you called from — specifically: a payment link for card orders, reservation confirmations, and reservation reminders. Message and data rates may apply. Message frequency varies and is typically limited to one or two messages per order or booking.
You may opt out at any time by replying STOP to any message from DialTone. Reply HELP for assistance. Opting out will prevent DialTone from sending a payment link, which means card orders placed by phone cannot be completed — you'll need to pay at the restaurant in person instead. DialTone does not use SMS for marketing and does not share phone numbers with third parties for their marketing.
05 Payments and refunds
Card payments are processed by Stripe under Stripe's own terms. When you pay by card, you authorize Stripe to charge the amount shown in the Checkout page on behalf of the restaurant. Refunds, price adjustments, and order disputes are the responsibility of the restaurant that took the order — contact the restaurant directly if you need to resolve an order issue.
For cash orders placed in person after being initiated over the phone, payment terms are handled between you and the restaurant at pickup.
06 Acceptable use
You agree not to use DialTone to:
- harass, abuse, or threaten the voice agent, the restaurant, or other callers;
- place fraudulent orders or reservations with no intent to pay or attend;
- probe, attack, or attempt to bypass the security of the service;
- violate any applicable law or regulation.
DialTone and the participating restaurant reserve the right to refuse service and block a phone number from further interaction for violations of this section.
07 Disclaimers
DialTone is provided on an "as is" and "as available" basis. While we work hard to keep the voice agent accurate and responsive, automated speech recognition and synthesis are imperfect, and the agent may occasionally mishear, misspeak, or misinterpret an order. DialTone encourages customers to review the SMS confirmation and contact the restaurant if an order looks incorrect.
DialTone disclaims any implied warranties of merchantability, fitness for a particular purpose, and non-infringement to the fullest extent permitted by law.
08 Limitation of liability
To the maximum extent permitted by law, DialTone's aggregate liability to any party arising out of or related to the service is limited to the greater of (a) fees paid by the restaurant to DialTone in the three months preceding the claim, or (b) one hundred US dollars. DialTone is not liable for indirect, incidental, special, consequential, or punitive damages.
09 Changes to the service and these terms
DialTone may modify the service, add or remove features, adjust pricing for restaurants, or update these terms from time to time. Material changes to these terms will be posted on this page with an updated "Last updated" date. Continued use of the service after a change constitutes acceptance of the updated terms.
10 Termination
A restaurant may cancel its DialTone subscription at any time. DialTone may suspend or terminate access to the service for violations of these terms, non-payment, or legal compliance reasons. Termination does not relieve either party of obligations incurred before termination.
11 Governing law
These terms are governed by the laws of the United States and the state in which DialTone is headquartered, without regard to conflict-of-law principles. Any dispute not resolved informally within a reasonable time shall be submitted to the exclusive jurisdiction of the state and federal courts located in that jurisdiction. Specific governing state will be finalized in the lawyer-reviewed version of these terms.
